What Colorado Actually Requires of a Littleton Business
There is a lot of bad information online about what the state mandates. Here is what we can point to in the statute.
Workers’ compensation — required at one employee
Colorado requires workers’ compensation coverage if you have one or more employees, and the Division of Workers’ Compensation is explicit that this includes part-time employees, full-time employees, and family members. There is no small-employer exemption to grow into. One part-time weekend hire triggers the mandate.
Under C.R.S. 8-43-409, an employer operating without required coverage can be fined up to $250 per day for an initial violation, and between $250 and $500 per day for a second or subsequent violation — and the director may order the business to cease operations while the default continues. Separately, under C.R.S. 8-43-408, an uninsured employer whose worker gets hurt owes an additional penalty equal to 25% of the compensation and benefits — payable into the Colorado uninsured employer fund, on top of the claim itself. The Division notes the average claim runs around $10,000, and a severe injury can exceed $500,000 — payable by you personally if you were uninsured.
Paying someone on a 1099 does not solve this. The Division’s own language: “Paying someone with a 1099 does not make them a contractor.” To be a genuine independent contractor in Colorado, the person must be free from your direction and control and have an independent business doing that specific kind of work.
Auto liability — 25/50/15 is the floor, not the answer
Colorado’s statutory minimum auto liability limits under C.R.S. 10-4-620 are $25,000 per person / $50,000 per accident for bodily injury and $15,000 for property damage. That floor is the same whether the vehicle is titled to you or to your business. It is also nowhere near what a commercial contract will require of you, and nowhere near what a serious accident costs. If your business owns vehicles — or if your employees drive their own cars on company errands, which is a hired and non-owned exposure most owners have never heard of — this is worth a real conversation.
General liability — required by contract and by license, not by statute
Colorado does not have a statute that says a business must carry general liability insurance. What Colorado has instead is a stack of local licensing rules and private contracts that do. The City of Littleton, for example, requires contractors to carry $1,000,000 per occurrence and $2,000,000 aggregate commercial general liability, with the City named as certificate holder, in order to be licensed to pull permits. Your landlord’s lease will have a number in it. Your biggest customer’s vendor agreement will have a number in it. Those are the requirements that actually bind you.
A city business license, separately
The City of Littleton requires any business “engaged in commerce of any kind, including all service businesses,” home-based or commercial, to register with the city through a Business License / Sales Use Tax application. That is a tax registration, not an insurance requirement — but it is the one businesses most often discover late.
